Sen. Janice Bowling, a Republican from Tennessee, filed a bill on Wednesday that may have a big impact on transgender persons who are looking for domestic abuse shelters, restrooms, and other facilities throughout the state.
SB 0468 is a measure that would prevent transgender people from using restrooms, sleeping quarters, changing rooms, and shelters in public schools, juvenile detention centers, and correctional facilities.
The law mandates that sleeping quarters, toilets, and changing rooms be assigned based on a person’s sex given at birth rather than their gender identification, and it would force domestic abuse shelters to designate separate facilities for men and women.
Because they would only be permitted to use facilities that match to their sex at birth, transgender people would be affected.
The law also suggests similar limitations for juvenile detention facilities, public schools, and correctional facilities, mandating gender-specific sleeping arrangements during evening events and in facilities that house jailed people.
LGBTQ+ advocates, such as the Tennessee Equality Project, have voiced their worries about the measure on social media, stating that it directly threatens transgender people, especially transgender women.
They contend that the bill would put transgender people in dangerous situations by forcing them into facilities that do not correspond with their gender identity.
Under the proposed law, transgender people who prefer to use facilities that are congruent with their gender identity might be sued, as could establishments that permit mixed-gender sleeping arrangements or disregard the gender-specific regulations.
The “Women’s Safety and Protection Act,” as the measure is called, intends to safeguard women and girls, especially by prohibiting violence, sexual assault, and harassment in areas reserved for women.
Separating facilities by gender assigned at birth, according to the bill’s proponents, will help protect women and girls in schools, penal facilities, and shelters for victims of domestic abuse.
Critics, such as groups like UCLA School of Law’s Williams Institute, contest the argument’s viability, nevertheless.
